ga-h61m-usb3v Audio through HDMI

ok, so I have swapped out my motherboard due to a lack of support for NVidia 7300. and the graphics now works. however the new board ga-h61m-usb3v doesn't seem to have any audio through hdmi? below is the output of aplay -l and aplay -L

my question is.. is this a hardware issue where this board doesn't send audi through HDMI or is it a software issue that can be fixed?

Is HDMI audio enabled in the BIOS?

think I have figured out the problem, this board doesn't have audio through dvi, so there is not hdmi option in the bios

DVI is not HDMI with a different connector .. it is a video only standard
